US court dismisses lawsuit against Zhao Jian Zhong

THE federal court on Tuesday last week issued an order dismissing without prejudice the complaint of a company and a businessman against a man accused of failing to pay $1.5 million required by their agreement.

“Without prejudice” means that the lawsuit can be filed again.

Federal Judge Frances M. Tydinco-Gatewood noted that the plaintiffs were ordered to show cause why the matter should not be dismissed, but to date they had failed to respond.

The plaintiffs are Angel Villa LLC, a British Virgin Islands corporation, and its owner, Sergey Tkachev who sued Zhao Jian Zhong for breach of contract on May 26, 2017. The plaintiffs were represented by attorney Daniel T. Guidotto.

The complaint stated that Zhao Jian Zhong failed to pay the $1.5 million remaining amount under a contract involving properties on Mount Tapochau and four vehicles.

On Oct. 4, 2017, Senior Judge John C. Coughenour ordered the plaintiffs to show cause why the lawsuit should not be dismissed. He said no proof of service had been made against the defendant 90 days after the complaint was filed.

Judge Coughenour gave the plaintiffs 14 days to show cause or the lawsuit would be dismissed without prejudice.
