Tropical Garden, Imperial Pacific settle lawsuit

TROPICAL Gardens Inc. is asking the federal court to dismiss its lawsuit against Imperial Pacific International, saying they have already reached a settlement agreement.

Tropical Gardens, through attorney Daniel Guidotti, filed a stipulation to dismiss the complaint in the District Court for the NMI on Wednesday.

He stated that the parties reached a settlement during a settlement conference on June 2, and memorialized a settlement agreement signed by the parties on July 20.

Guidotti is asking the federal court to retain jurisdiction and enforce the irrevocable settlement agreement between Tropical Gardens and IPI.

The court is also asked to order each party to bear its own fees and costs, he added.

Tropical Gardens, which provides landscaping, plant rental, ground maintenance, and nursery supplies in the CNMI, sued IPI for breach of contract, promissory estoppels, and unjust enrichment.

Tropical Gardens said IPI breached its obligations to Tropical Garden under their supply and installation contract when in bad faith and without justification IPI unilaterally attempted to renegotiate the supply and installation contracts and refused to make further payments under either contract.

Imperial Pacific disputed Tropical Garden’s allegations.
