A 45-year-old man arrested for threatening to kill his wife with a crowbar will be sentenced to time served.
Jose S. Mangundayao was originally charged with assault with a dangerous weapon, assault and battery, and interfering with a domestic violence report.
At Tuesday’s change-of-plea hearing, Mangundayao, “who desires to resolve the offenses charged via a non-trial disposition,” pled guilty to assault and battery, interfering with domestic violence report and disturbing the peace.
Mangundayao appeared before Superior Court Judge Kenneth L. Govendo with Assistant Public Defender Nancy Dominski and court interpreter Grace O. Boggess while Assistant Attorney General Teri Tenorio represented the government.
According to the plea agreement, Mangundayao will be sentenced to a term of imprisonment of two years and nine months, 566 days of which are suspended. He will also be given credit for time served of 344 days. On Tuesday, Judge Govendo ordered the defendant’s release from jail.
But Mangundayao will be placed on three years probation and must pay restitution of $770, court costs and fees. He was also ordered to stay away from his wife.
The factual basis for the plea stated that on or about Jan. 30, 2017, Mangundayao did unlawfully strike, beat, wound or otherwise cause bodily harm to his wife: the defendant choked her and grabbed her arm as she attempted to escape, causing a bruise on her left arm.
In addition, Mangundayao did knowingly interfere with his wife who was reporting or attempting to report a crime involving domestic violence to a law enforcement agency.
Moreover, the defendant did unlawfully and willfully commit an act which unreasonably annoyed or disturbed the peace of his wife depriving her of peace and quiet, and threatened to kill her.
Mangundayao’s wife told police that he choked her and then grabbed a crowbar and threatened to kill her.
She said her husband accused her of having an affair with a friend on Facebook.
