Cling Kaipat to undergo psychological examination

THE federal court Wednesday ordered Cling Philip Gilbert Kaipat to undergo a psychiatric or psychological examination to determine if he is competent to proceed with sentencing.

Kaipat, who has been convicted of illegal possession of a firearm, appeared before District Court for the NMI Chief Judge Ramona V. Manglona with court-appointed counsel Colin Thompson. Assistant U.S. Attorney Garth Backe represented the federal government.

Kaipat was asked by the judge if his defense counsel went over the presentence investigation report with the defendant. Kaipat said he did and that he understood the report.

 The judge also asked the defendant if he felt that his sentencing should proceed or if he felt he was not in the right state of mind.

 Kaipat told the court that he was not in the right state of mind, but that he was taking his medications which, he added, were causing some side effects.

 In her order, Judge Manglona said Kaipat’s psychological examination should be held at a facility where the defendant was previously assessed.

 The judge scheduled another status conference for July 11, 2018 at 9 a.m. and remanded Kaipat to the custody of the U.S. Marshals Service.
